Breaking news: Supreme Court of Appeal says Fabricius was wrong on Euthanasia

Last year, South Africa's High Court determined that a terminally ill patient may, with the help of a doctor, kill himself (self-murder)

The following newsletter came from Philip Rosenthal of the Christian View Network, who is also coordinator of Euthanasia Exposed.



BREAKING NEWS: Today, 6 December 2016 the Supreme Court of Appeal said that Judge Fabricius was wrong in his 2015 judgement authorising Robert Stransham-Ford to have assisted sucide/euthanasia.

The court confirmed this is really a matter for elected parliament and not judges to decide.  The decision was made in haste and did not properly consider South African law, the international context, our social values or the impact on the right to life.  The medical information provided to the court was flawed and contradicted the real medical records, which were withheld until a court order was issued.  The case was manipulated by the euthanasia lobby group, its lawyers and the estate, and the medical records indicate Stransham-Ford was actually asking if he could back out of euthanasia/assisted suicide.

The court judgment used many of the same reasons which we wrote in our article 'Why judge Fabricius was wrong':

* The separation of powers requires that parliament as representatives of the country as a whole should decide any changes on the law rather than requiring judges to decide.
* The applicant died before the ruling was given.  Circumstantial evidence seems to indicate this information may have been deliberately withheld from the court.
* Judge Fabricius ruling was decided in haste (one day) on a matter of national importance, an urgency apparently manufactured on an individual case by the lobby group Dignity SA.
* The applicants attorneys had refused to provide the opposing friend of the court legal teams with information they needed to respond.
* The South African situation is different to the juristictions where euthanasia is legal, which argues against foreign cases being used as precedent.  We have different social values, a different socio-economic and
policing situation.
* The applicants affidavit was factually and medically doubtful on many points.
* The organisation Dignity SA was publicly raising funds to pay for the court case, but the application insisted it was just on behalf of the individual.
* The hasty Fabricius judgment did not properly consider South African law or international precedent cases.
* Judge Fabricus was wrong to assume that the common law on murder needed to change to accommodate assisted suicide and euthanasia.
* The court needs to consider whether its decision would undermine the foundational value of the right to life or be supportive of it.

Further reasons emerged from the judgment, which we were not aware of:
* The picture of Mr Stransham-Ford's final illness as depicted in the legal affidavits bore little resemblence to reality as found in his medical records.
* The psychologist who declared the applicant Robert Stransham-Ford to be psychologically fit and his desire to apply for suicide, did not provide reasoning on how the conclusion was reached and previously lived in the same
street as him, which raises questions of independence.
* The applicants doctors medical records indicate he was wavering in his desire for suicide/euthanasia and asked his doctor if he could change his mind and that his real medical situation was very different to that described in the affidavits.  The estate of Stransham-Ford had refused to release these medical records until a court order was issued for them. [Our comment on this is that it is very normal for people to waver in their desire for suicide, but suicide is irreversible, and this is a strong argument against legalising suicide.]

The Centre for Applied Legal Studies, at Wits submitted argument to the court that euthanasia and assisted suicide were working well overseas.  The Health Professions Council of the State and the State submitted detailed evidence rebutting these claims and giving evidence of numerous abuses and problems overseas.  The court provisionally accepted this evidence but after reviewing it, decided that it was too complex and detailed to sift through or decide on.  Possibly the same rebutting evidence may be used again in future on another case.

One point in the judgement which we at Euthanasia Exposed are not happy about is a single sentence in the conclusion that can be interpreted to open the possibility of the court considering another case to legalise
euthanasia/assisted suicide - something that logically conflicts with all its other arguments especially that the decision is really an issue for parliament and not judges.  If another case comes, then the battle will continue.  The euthanasia lobby have no chance success in the government or parliament, having been defeated before.  With the body of evidence collected against euthanasia, ready for any future case, their chances of
success are reduced.

A special day! A day of horror! The Unborn (1 Feb 1997-1 Feb 2011)

Today, 16 years ago at 13:55 my daughter, Nicole, was born! It was such a day of joy, happiness and pure exhilaration! That day I simply couldn’t contain myself. After we left the “delivery” theatre, the nurse wanted to clean Nicole up, but I insisted that no-one but I may give Nicole her first bath. While I was holding that tiny little body in my hands, her head resting softly in my left palm, I couldn’t help but thank God for such a precious gift! Now, 16 years later, I am a proud father of a young girl who is a hard worker at school, and apart from coming second in her grade  (9) last year in academics, she also gets awards for displaying the fruit of the Spirit every year. She is indeed a joy!

February 1, 1995, was indeed a wonderful day, especially for our family!

However, February 1 did not remain such an incredible day for long! Even though, in our family it remains a day of wonder and celebration, a day of infamy dawned on South Africa on February 1, 1997. On this day in 1997, the Bill on the Termination of Pregnancy (TOP) became law. Since then, somewhere between 750,000 and 1,000,000 babies have been brutally murdered!

Obama’s evil abortion record

U.S. President, Barack Hussein Obama, claims to be a Christian, and has made several comments about his faith. However, when it comes to abortion (which I believe is absolutely anti-Christian), Obama has a putrid pro-abortion record behind his name. The stench of abortion hangs on Obama like that of a rotting corpse!

Obama’s pro-abortion record since being elected as U.S. president on 4 November 2008 reads like a horror novel. The difference is that this is real life! This is like the Texas Chainsaw Massacre by presidential fiat.

While I am reticent to simply say Obama is not a Christian, let the fruit speak for itself!

Join the Baby wars

Here in South Africa a total of 210 rhinos have been killed in 2010 for their horns to satisfy the 'horny' (forgive the intended pun) desires of degenerates in the far east. These lunes will pay top $$$ for rhino horn because they believe it has some kind of medicinal value and the power to give them sexual prowess. Why don't these people not just chew their own hair?

Anyway, these majestic animals are being killed for nothing! And that is a shame. And, outrage against this trade is the right response! Hence, there is a call to Join the Rhino Wars.

However, why don't these people show outrage against the vicious, conscienceless killing of another sort? That of millions of human babies every year! Enough human babies are being aborted worldwide every year to have decimated the populations of some countries!

Christian Voting Must be Biblically Based

It is always interesting to talk to people to hear their criteria for choosing who to vote for in an election. With the 2009 elections coming up on 22 April, it is time again to hear the ideas of people. People have different reasons for why they vote for certain political parties.

Most people look at financial issues, hence, their political outlook is mostly for personal gain. How can the government make my life better? This of course shows a dependence on the government. This is also not just an issue for the poor! The rich have the same thoughts. They would like a government that will ensure that their riches don't get squandered on unnecessary taxes, or will at least see to it that the money of the rich will keep on growing.

As Christians, we march to the beat of a different drum… a heavenly drum! And that drum is not beaten by us, the Christians, but by the Lord of the universe, Jesus Christ Himself. It is very much a Lordship issue, even in deciding who we will vote for in a political election.

God is not uninterested in politics! This is not that one sphere of life where God leaves man to his own devices. This is not a no-go zone for God! "The earth is the LORD's and the fullness thereof, the world and those who dwell therein. (Ps 24:1)" To think that God can be excluded from any sphere of life, no matter how corrupt it has become, shows a naivety that does not belong with clear thinking people.

Politics, essentially has nothing to do with power. It primarily has to do with justice and care for a nation. It is exactly the quest for power by politicians that nations end up like Zimbabwe, DRC, Middle-East and China. Politics is about the good of the country, not about the individuals leading the country. As Lord Acton once said: "Power tends to corrupt, and absolute power corrupts absolutely." This is too much of a reality in our modern world not to take notice of it.

So, how does this choice of who to vote for affect Christians? When we look at who gets the vote in South Africa, it makes one wonder how many Christians actually march to the heavenly drum! Up until our last elections, it has been the ANC and DA as number one and two parties respectively.

Those results are quite perplexing, considering that about 70% of the population claims to be Christian. Why is this perplexing? Well, if one looks at the South African Voter's Guide, it becomes clear that these two parties stand antithetically opposed to Biblical Christian values.

savotersguide In all of life, Christians are admonished by the Scriptures to obey God. Why is it that they think it would be acceptable to disobey when they vote in elections?

Christians simply do not not have the luxury of making up their "own minds" on issues that have been clearly spelt out in the Scriptures. That is on any issue in life. Yet, it is true that the Scriptures do not tell us who to vote for. However, that does not give us an escape route to vote for parties that do not stand on the Lord's side!

In making up our minds who to vote for, there should be a clear procession of thought on the issues. As Christians, our decision must be guided by clear Biblical mandate first. That means, where the Bible speaks clearly, we have to follow. If the Bible is clear on the issue of murder, we cannot vote for a party that supports abortion, ala ANC and DA. The Bible is clear on murder. You get the point! Therefore, Biblical moral issues must be adhered to first in our decision before any other issues that are based on conscience or expediency.

So, issues such as abortion, pornography, homosexuality, prostitution and the like must take precedence in your decision who to vote for. The Bible is clear on these issues. There are clear commands and Biblical doctrine on each of these issues and other moral issues. As a result, issues of conscience, on which the Bible has no clear teaching, must play second fiddle to moral issues. Even more so, issues of expediency such as simple economic issues.

If Christians do not use their votes towards establishing Biblically righteous government, they are indeed using their votes towards evil. And, perpetuating evil in this way is clear disobedience against the clear statutes of God. "Without virtue, a society can be ruled only by fear, a truth that tyrants understand all too well."1 Already, the ANC is planning to amend the South African Constitution if they win a two-thirds majority.

Voting by a Christian must result in a better country with justice for all. A better country can only be seen as a righteous country. It does not have to be a country where all its citizens are Christians, but it will be a country where the people understand what is right and what is wrong, and where the law and its application brings true justice for all.

There are many Christians that vote for both the ANC and DA. They vote for the ANC as the so-called liberators from apartheid, and others vote for the DA as a so-called strong opposition to the ANC. With the upcoming elections, there will also be the breakaway party, COPE. When you look at the SA Voter's Guide, you will realise that COPE's policies are exactly the same as that of the ANC. In fact, of the 8 issues in the guide, the ANC and COPE get 0/8 and the DA get 2½. The ½ of the DA here is only because of stated policy, disregarding their poor voting record in parliament.

Remember, voting is a Christian duty. In a democracy, your vote can actually effect change. Your vote can move this country closer towards justice and righteous government. Don't throw that vote away by denying a party perhaps just that one vote it needs to have someone put into parliament. Further, don't waste your vote on the memories of so-called past liberation or on the promise of so-called strong opposition, especially when both of these sides stand for very much the same when it comes to moral issues.

Let your vote count towards righteous government, and vote for a Christian party such as the ACDP or CDA.

Christian, do not support and perpetuate immorality by giving your vote to parties that do the same! Do not vote through fear, but rather let your vote reinforce Christian Biblical values!

Sanctity Life Sunday - 1 February

There are over 36 000 churches and 30 000 ministers in South Africa. If just half of them could be inspired to observe Sanctity Life Sunday in repentance and prayer and to study what the Word of God teaches on the Sanctity of Life then we could begin to end the legalised killing of babies in South Africa.

"Rescue those being lead away to death; hold back those staggering towards slaughter. If you say, but we knew nothing about this, does not He who weighs the heart perceive it? Does not He who guards your life know it? Will He not repay each one according to what he has done?" Proverbs 24:11-12

Most of the medical personnel in our country are church members. Most of the mothers go to church. Most of the voters in South Africa claim to be Christians.

If Christians in South Africa could stop and look at the abortion holocaust in the light of Scripture, if we could understand something of the heart of God on this disgraceful abomination - then we would be roused to action. There are 20 million church members and adherents in South Africa. If most of these church goers could understand what the Bible teaches about when life begins, the sanctity of life, and our Christian responsibility to stand up for the right to life of pre-born babies - then we could save thousands of precious lives from abortion.

The goal of Sanctity Life Sunday is to encourage pastors in South Africa to preach on what the Bible teaches on the subject of abortion on 1 February. It is also hoped that many Christians will observe Friday, 30 January as a National Day of Repentance for the national sin of abortion.

"If My people who are called by My name will humble themselves and pray and seek My face and turn from their wicked ways, then will I hear from Heaven, and will forgive their sin and heal their land." 2 Chronicles 7:14

Sanctity Life Sunday: Prayer of Repentance

Almighty God, we bow before You our Creator, You are the One who has given us life and health, talents, gifts and opportunities for service. Every breath we breathe is a gift of Your grace. We acknowledge that You are also the Eternal Judge before Whom each one of us must stand and give an account of our lives. Have mercy upon us. Lord. Do not treat us as we deserve. We plead for Your mercy - for Your grace. Your undeserved favour. For we confess that we are a sinful people and we are part of a nation in rebellion against You.

We have broken Your Holy Laws.

Our leaders are too proud to bow before you in prayer at the beginning of Parliament.

At state events our leaders have committed idolatry, worshipping other gods who are not God at all.

Your Name is routinely taken in vain on national television and at cinemas and this blasphemy is constitutionally protected and regarded as "entertainment."

The Lord's Day is desecrated every week. What You ordained as a Day of rest and a Day of worship is being commercialised and abused for the worship of pleasure.

Respect for our parents and elders is being undermined everywhere by the laws, the entertainment industry and by the explosion of violent crimes against the elderly.

Every year over 20 000 people are murdered in South Africa and our Justice system is failing to protect the citizens of this land. Most of the murderers who terrorise our people escape being brought to justice. In fact our laws seem to favour the rights of the criminals and all too often criminalise the victims. Have mercy on us Lord.

Selfishness, greed, covetousness and deception are pervasive and we have become a nation infested with corruption and theft. Our Constitution entrenches the rights of pomographers to exploit people made in the image of God for profit - to take what You have made to be holy and perverted it, to take what You designed to be special and made it sordid, to distort what you intended to be private and developed it into a multi million rand exploitative industry. Have mercy on us Lord.

And we must admit that we have the hypocrisy to claim to be a "human rights society" while denying the right to life to pre-bom babies. Forgive us Lord for interpreting the Right to Life to protect guilty murderers from execution but not protecting innocent babies from receiving the death penalty through abortion.

We are ashamed that our society could have become so calloused, careless and cruel as to allow little babies to be poisoned, burned, dismembered, smothered or strangled - through abortion.

We recognise that all that is necessary for evil to triumph is for good people to do nothing. And we must confess that most of us, even in the Church, have shamefully done nothing to protest and work against the legalised slaughter of pre-born babies in South Africa.
You have declared that "Whatever you did not do for one of the least of these, you did not do for Me." (Matthew 25:45). We recognise that to know the good we ought to do and to fail to do it is sin (James 4:17).

We have sinned. We have not loved You with all our heart, soul, mind and strength, nor have we loved our neighbours as ourselves. We have not done unto others as we would have others do unto us. We have been thoughtless and careless. We have been self-centred and preoccupied with less important things. Forgive us for thinking so much of ourselves and so little of You and of our neighbours. Especially on this day, we confess that we have not loved our unseen, pre-born neighbours as we ought. Have mercy upon us, 0 Lord.
On behalf of our congregations, communities and nation we repent of the national sin of abortion. May You be merciful and gracious 0 Lord to forgive us our many sins and to bless us with a revival of repentance.

May You raise up many more Christians to fight for the right to life of pre-born babies.
May you grant to mothers going through crisis pregnancies _ grace, comfort, strength and the support of family, friends and congregations _ to choose life that the children may be born and brought up in the love and admonition of the Lord.

Lord, raise up more pastors, elders, deacons and church members to see the needs and to educate and mobilise their congregations to respect the sanctity of life, and lovingly support both mothers and children - especially in crisis situations.
Strengthen the doctors and nurses to resist all pressures to pervert their healing profession from saving lives to taking lives. May the medical profession stand together in resisting the overwhelming pressures to turn them into paid assassins instead of those who are true to their Hippocratic oath.

And we also pray that You may grant that those politicians who worked and voted to legalise abortion in South Africa would come to repentance. And should those guilty of unleashing this abortion holocaust steadfastly refuse to repent, then we pray that You, 0 Lord, may remove them.

May you raise up new leaders who will respect the right to life of even the most helpless members of our society and ensure that babies are effectively protected from the violence of abortion - by law.

Guide each one of us, 0 Lord, as to what we can do to save lives and love our neighbours, for we ask all this in the Name of our Lord and Saviour Jesus Christ - Amen.
What You Can Do

Inform your congregation or cell group/Bible Study: This Sunday (1 February), is Sanctity Life Sunday. Pro-life resources: God's Miracle of Life DVD, Pro-life leaflets, Make a Difference: a Christian Action Handbook for Southern Africa. The leaflets, sermons and Bible studies can be downloaded from Pro-life Resources on the Christian Action website.

Be interceding:
• For Christians, that they would understand when life begins and that abortion is murder.
• That medical personnel would refuse to have any part in the killing.
• For mothers in crisis pregnancies, that they would find help and choose loving options such as adoption.
• That lives would be saved.
• That journalists would publish the other side of the story.
• That many more pastors would be encouraged to speak up for the right to life of pre-born babies.
• That the Lord will bring conviction of sin to those who have worked to legalise this slaughter of the innocents; and
• That the Lord would persuade abortionists to repent from this evil;

Sarah Palin's "Speech of the 21st Century"

British pro-life activist, John Smeaton, director of Society for the Protection of Unborn Children, wrote that Sarah Palin's speech in Pennsylvania on Saturday could be regarded as the “most significant” political speech of the 21st century.

In the speech Sarah Palin said:

"I believe the truest measure of any society is how it treats those who are least able to defend and to speak for themselves. And who is more vulnerable, or more innocent, than a child?...

"Yes, every innocent life matters. Everyone belongs in the circle of protection. Every child has something to contribute to the world, if we give them that chance. There are the world’s standards of perfection – and then there are God’s, and these are the final measure."

Barack Obama: America's future president of death?

Is this whom Obama represents?A poll in the U.S.A. recently showed that some pro-life voters would vote for Barack Obama if he gets to stand for the presidency against McCain. I don't care much for McCain! If he wins the Republican nomination for the presidency, IMHO, he will probably be the worst Republican candidate in decades.

But, back to Barack "Obamanation." When it comes to pro-life issues, he seems to be the worst. Perhaps even worse than Hillary Clinton. In a speech before the Planned Parenthood Action Fund, he clearly spelt out his disdain for human life before birth. He even supports Partial Birth Abortion. Obama's record is clearly in favour of abortion, of any kind, it seems!



Obama also has spoken out his regret in "supporting federal legislation aimed at saving the life of Terri Schiavo. He even suggested the legal efforts to stop Terri's death by dehydration and starvation constituted a 'costly' action."



Clearly, for Barack "Obamanation" choice (for whom?) and cost have more value than a human life!

The slippery slope of the 'Pro-Choice' mantra

In the area of abortion, where people murder babies daily, it truly seems that pro-choicers are now completing their "evolution" to becoming zombies. They are now becoming the living dead! Living bodies without soul, without heart. The result of this zombification is a people who would murder their own children for any reason whatsoever! Or, for no reason at all!

Piper on abortion

John Piper, classified as the king of Protestant social theology wrote an amazing review of the U.S. Supreme Court ruling in upholding the ban on partial birth abortion.

Quoting from Piper's first paragraph, "Justice Anthony Kennedy wrote the opinion of the Supreme Court in upholding the ban on partial birth abortions on April 18, 2007. It is astonishing to read the opinion (PDF). The detail with which abortion is discussed exceeded my expectation. Kennedy’s own descriptions of the various forms of abortion are explicit and extensive. Descriptions of the procedure of partial birth abortion ('intact dilation and extraction') are given from both doctors’ and nurses’ perspectives."

Guess who will continue killing children after they are elected for U.S. President

After the U.S. Supreme Court ruled on 18 April 2007, upholding the U.S. wide ban on partial-birth abortion (PBA) in a 5-4 vote, current presidential hopefuls weighed in with their comments.

As would be expected, the Democratic runners disagreed strongly.

Hillary Clinton:

"This decision marks a dramatic departure from four decades of Supreme Court rulings that upheld a woman's right to choose and recognized the importance of women's health. Today's decision blatantly defies the Court's recent decision in 2000 striking down a state partial-birth abortion law because of its failure to provide an exception for the health of the mother. As the Supreme Court recognized in Roe v. Wade in 1973, this issue is complex and highly personal; the rights and lives of women must be taken into account. It is precisely this erosion of our constitutional rights that I warned against when I opposed the nominations of Chief Justice Roberts and Justice Alito."

Barack "Obamanation" Obama:
"I strongly disagree with today’s Supreme Court ruling, which dramatically departs from previous precedents safeguarding the health of pregnant women. As Justice Ginsburg emphasized in her dissenting opinion, this ruling signals an alarming willingness on the part of the conservative majority to disregard its prior rulings respecting a woman’s medical concerns and the very personal decisions between a doctor and patient. I am extremely concerned that this ruling will embolden state legislatures to enact further measures to restrict a woman's right to choose, and that the conservative Supreme Court justices will look for other opportunities to erode Roe v. Wade, which is established federal law and a matter of equal rights for women."

John Edwards:
"I could not disagree more strongly with today's Supreme Court decision. The ban upheld by the Court is an ill-considered and sweeping prohibition that does not even take account for serious threats to the health of individual women. This hard right turn is a stark reminder of why Democrats cannot afford to lose the 2008 election. Too much is at stake - starting with, as the Court made all too clear today, a woman's right to choose."

It is amazing how these presidential "hopefuls," God forbid that they be elected, can take one of the most gruesome methods of murder, and veil it in "choice" language!

Do these people really think people are that stupid to actually believe that PBA could save a woman's life? The fact is that the whole body of the baby is already born, when the baby is cruelly murdered by driving scissors into the bottom of the skull and the brains sucked out, while the head is still in the cervix! How could this prevent a woman's death?

It does not save a woman's life, but rather, it murders a baby that needs ONLY another 6 inches to go for a complete birth!
